    Term & Conditions

    These Terms and Conditions, detailed hereinafter, govern your use of Qatar Credit Bureau App. Qatar Credit Bureau (hereinafter referred to as “CB” or "we" or “our” or "us"), in these Terms and Conditions “You” or “Your” refers to the Customer/ the User.

    By accessing and using the App you are deemed to have understood and agreed to this Terms and Conditions.

    Definitions:

    In these Terms and Conditions, the following words shall have the meanings shown opposite each of them, unless the context requires otherwise:

    "CB" means Qatar Credit Bureau, a credit bureau established by Qatar Central Bank,

    "App" means the software application that is owned and operated by Qatar Credit Bureau for the provision e-services (the “Services”) as defined hereinafter below,

    “Services” means internet and mobile services that CB provides via the App that can be developed and modified from time to time.

    "Law" means Qatar Central Bank and the Organization of Financial Law No. [13], 2012;

    "Device" includes personal computers, laptops, computer tablets, mobile phones, smart phones, wearable devices (watches, fitness trackers), connected car system devices and any other similar devices that may be connected to the internet and used for online and mobile services.

    “Customer” means the person who has obtained a credit facility from a member and whose credit information has been provided to CB.

    "User" means the customer of CB, being an individual and/or a legal entity represented by an individual, who will obtain the Service via the App;

    “Credit Information” means information or data related to the credit facility obtained by the Customer or any other persons related to the credit facility obtained by the Customer, which is in the possession of the Member and which the Member provides to CB.

    "Credit Report” means the report issued by CB that includes Credit Information and any data related to the Customer, or any other persons related to the credit facility obtained by the Customer.

    “Member(s)” means banks, other financial institutions and commercial companies that grant credit facilities that have subscribed to CB's membership under the membership agreement, and who have agreed to provide and exchange data and Credit Information through CB, including their legal successors and authorized persons.

    “State”: means State of Qatar.

    Use of the App:

    This App is owned and operated by Qatar Credit Bureau

    By using this App, you acknowledge that you have read and accepted our “Terms and Conditions” and “Privacy Policy”, which are available in both Arabic and English. In the event of any difference in interpretation between the Arabic and English text and any translation thereof, the Arabic text prevails.

    Intellectual Property Rights:

    1. Intellectual property rights mean any rights found in any patent, design, trademark and trade name (whether registered or not), and copyright and related rights, in addition to all other intellectual property rights and all applications and renewals related to any of those rights.
    2. All materials on this App, are protected by copyrights, trademarks, and/or other intellectual property rights. These materials are owned by CB or are used with permission from their owners or as otherwise authorized by law. Protected materials include, but are not limited to, the text, trademarks, source code, databases, logos, photographs, images, video clips, audio clips, designs, trade dress, and other materials contained in this App. All rights are reserved, worldwide.
    3. Subject to the Terms and Conditions stated in this document, all credit information entered into the CB's database, and the rights that are classified as intellectual property rights and neighboring rights in accordance with the law and established by CB that pertain to or related to credit information, according to these Terms and Conditions, are property for CB.
    4. All other use of any material (including, without limitation, photographs, articles, press releases, software, comments, tables or charts, video clips, logos) on this App is strictly prohibited. By way of illustration, such prohibited use may include the extraction, redistribution, republication, modification, broadcasting, sale, or otherwise making available of any of the information or material on this App (in any format) to third parties. In addition to this restriction, you agree to comply with all copyright notices, information, or restrictions contained in any material accessed through this App. Unauthorized use of this App, or any of the information or material contained on this App, is illegal and as such may give rise to, amongst other things, a claim for damages and may also be a criminal offence.

    Eligibility:

    1. CB grants the User a non-exclusive and non-transferable right to use the App in accordance with these Terms and Conditions.
    2. CB reserves the right to refuse any application for Services and may in its sole discretion withdraw, cancel or modify the Services (including discontinuing any features or content of the App) and/or these Terms and Conditions at any time.
    3. By accessing any Service, the User confirms his acceptance of the Terms and Conditions effective as at the date of such access. The User understands that such acceptance will be sufficient and binding on the User for all intents and purposes. These Terms and Conditions will become effective when the User accesses any Service and constitute a binding agreement between CB and the User for the provisions of the use of the App.
    4. Notwithstanding the above, the User undertakes to submit any additional documents that may be required by CB prior to provision of any enhanced, modified or additional Service to the User. Where a User fails to comply with the above requirements, the User shall not be eligible for such enhanced, modified or additional Service and CB will be entitled to withdraw the Service provided at its discretion.
    5. Users must download the latest available version of the App to benefit from the latest features, technical updates or improvements, and security protection. Users should use only compatible browser versions with the internet services (where applicable) and have an antivirus software installed and active on their Devices at all times. Users acknowledge that they are solely responsible for the security of their Devices.
    6. The Users recognize and accept that their primary mobile numbers will be used to initiate and receive an authentication code (one-time password). The User is responsible for keeping this one-time password and the Device protected at all times and to update the number in CB’s records in case of any change to the primary number.

    Unauthorized Actions or Uses:

    You agree that you will use this App only for the purpose for which it is intended. You will not attempt to interfere with the operation of this App, or alter or corrupt any related data or software. You understand that if you attempt to alter or corrupt any related data or software, it may lead to denial of access to this App and possibly legal action being brought against you.

    Failure to Comply:

    You agree to follow and abide by these Terms and Conditions and by all directives and instructions issued through the App by CB or Qatar Central Bank. You understand that a failure to follow all directives and instructions may lead to legal action being brought against you.

    Disclaimers and Limitations of Liability:

    1. Whilst the service and all other App material is provided in good faith, by using this App, you agree and acknowledge that CB makes no representations, warranties, or claims as to the accuracy of the credit information or any other material on this Apps.
    2. CB disclaims all implied warranties relating to your use of this App and the information, products, and services contained in this App. To the maximum extent permissible under law, all information on this App is provided without any warranty (either express or implied by law or otherwise) or implied term of any kind, including but not limited to any implied warranties or implied terms of satisfactory quality, fitness for a particular purpose, or non-infringement of third-party rights.
    3. By using this App, you agree that CB will not be liable to you for any direct, indirect, consequential, or any other loss arising from the use (or non-use) of the information, products, and services provided to you through this App or from your access of other material via links from this Apps. The exclusions and limitations contained in these Terms and Conditions apply to the maximum extent permitted by law.
    4. CB will be under no liability to you whatsoever, whether in contract, tort (including negligence), breach of statutory duty, restitution, or otherwise for any injury, death, damage, or direct, indirect or consequential loss howsoever caused arising out of or in connection with the use of this App or the use, accessing, downloading, or relying on any information or other materials contained in this Apps, including, without limitation, as a result of any computer virus.
    5. You shall indemnify CB and its employees and keep CB and its employees indemnified against all losses, damages, claims, and costs (including legal cost) caused or suffered by CB and/or its employees as a result of a breach by you of any of these Terms and Conditions.
    6. You understand and agree that you shall be accountable and be fully responsible at all times for:
      1. maintaining the confidentiality of your passcode (if any) to use this App. You agree not to share and disclose your passcode to any person whosoever and to take all reasonable precautions necessary to ensure that no other persons have access to the same.
      2. If you discover any breach of security or have reasonable grounds to believe that someone has used your passcode without your authorization, or has, in your judgment, violated these Terms and Conditions, you should change your passcode or contact us immediately.
    7. It is the user's responsibility to independently verify the accuracy, continuity, completeness, relevance and fitness of all information input by the user or output by this App prior to executing any transaction using this App.
    8. CB will not be liable for any degradation in the quality of this App or the unavailability of this App.
    9. CB will not be liable in case there is an unforeseen downtime due to network outages, problem at the hosting facility or any other reason beyond our control which may result in non-availability of this App for any duration.
    10. CB may suspend and/or terminate your access to this App immediately for any reason without notice and without any liability whatsoever should you be in breach of these Terms and Conditions or for any other cause.

    App Malfunctions:

    1. CB does not guarantee the availability of the services provided via the App at all times or without interruption, nor is it free from errors or any faults, or that any technical defect that is identified can be fixed or corrected as this depends on the incoming programs or technology media, which is not guaranteed to be completely free from errors and faults.
    2. CB does not guarantee that the services provided through this App will be free from viruses or any other influences, codes, encryptions, programs or destructive materials, as the provision of such services through electronic means relates to factors outside the control of CB, and in general CB undertakes to use approved and generally accepted technologies according to technical standards in order to verify that the programs are free of viruses from time to time.

    Modifications of Terms & Conditions:

    These Terms and Conditions and/or other information provided on this App may be updated, amended, changed, or removed by CB at any time. CB reserves the right to vary, amend or modify or impose new conditions in these Terms and Conditions at any time and without further notice to you. The Terms and Conditions will always be updated and available through the App. You should review these Terms and Conditions every time you visit the App. By using this App, you agree to be bound by the latest version of such Terms and Conditions.

    Miscellaneous:

    1. These Terms and Conditions (including the Privacy Policy) contain all the terms relating to the use of this App. These Terms and Conditions supersede all previous contracts, arrangements, representations, terms implied by law, and understandings between the parties whether written, arising from custom, orally, or otherwise. These Terms and Conditions are written in Arabic and English. If you do not understand Arabic or English, please seek assistance in order to understand these Terms and Conditions, as you will be deemed to have understood and accepted these Terms and Conditions upon use of the App. In the event of a difference between the two texts, the text in the Arabic language shall prevail.
    2. If any part of these Terms and Conditions are found by any court, tribunal, administrative body, or authority of competent jurisdiction to be illegal, invalid, or unenforceable then that provision will, to the extent required, be severed from these Terms and Conditions and will be ineffective without, as far as possible, modifying any other parts of these Terms and Conditions and this will not affect any other provisions of the amended Terms and Conditions, which will remain in full force and effect.
    3. There shall be no waiver of any term, provision, or condition of these Terms and Conditions, unless such waiver is evidenced in writing and signed by the party granting such waiver.
    4. This App provides information to individual users, institutions, and companies. In an effort to avert the potential of scams, frauds, and to ensure the legitimacy of transactions, which may cause harm or loss to the public, Qatar Credit Bureau advises all persons, and institutions dealing with individuals claiming to be Qatar Credit Bureau employees or representatives to ensure their authenticity prior to any such dealings.     5. This App contains links to Apps owned and operated by third-parties. CB does not control such Apps, and is not responsible for the content and performance of these apps and sites. Qatar Credit Bureau does not intend links on its App to be referrals or endorsements of the linked entities, and are provided for convenience only. The inclusion of links to other Apps does not imply any endorsement of the material on that apps and web sites. Use of other Apps is strictly at your own risk.
    6. CB monitors this App for security purposes. By using this App, you expressly consent to such monitoring. Unauthorized attempts to upload or change information on this App, to defeat or circumvent security measures, or to utilize this App for other than its intended purposes, are prohibited. Any evidence of such attempts may be referred to concerned law enforcement agencies.
    7. Without any responsibility, CB shall have the right at any time to suspend permanently or temporarily all the services provided through this App or any of them, according to what CB deems appropriate without prior notice.

    Data & Information of the App:

    CB provides the App information to interested individual users, local, and international institutions, and companies. By accessing this App, or using the information, data or material provided therein, you acknowledge and agree to the following terms and conditions:

    1. All texts, data and information on this App are owned by the CB. Digitized photographs, graphics, and logos contained are the property of the CB, and may not be used without written permission from CB. CB does not permit the use of its name in any advertising, as an endorsement for any product or service, or for any commercial purpose, without its prior written permission.
    2. All texts, data and information on this App shall be used for the purposes of legitimate personal use, that is not for the purpose of private or commercial gains. CB may allow to store or reproduce any information, data or documents posted herein..
    3. Any ways or through any means, provided that they shall be properly credited to the CB Except for the authorized use in the previous paragraph, any information and material or related graphics on the App shall not be copied, displayed, distributed, downloaded, licensed, modified, published, re-posted, reproduced, reused, sold, transmitted, used to create a derivative work or otherwise used for public or commercial purposes without the CB's prior written permission.
    4. CB takes reasonable measures to ensure that the data and other material on this App is correct and complete, but CB shall not accept any liability for any error or omission from the App. CB provides no warranty as to the accuracy, timeliness, completeness or fitness for any particular purpose of information available through this App. Any conclusions that users draw from the information presented here are subject to their decisions and the users shall be solely liable for such decisions.

    Marketing communications:

    By acceptance of these Terms and Conditions, the User agrees to receive CB news releases, products communication and user experience information via registered emails and mobiles.

    Privacy Policy:

    This Privacy Policy provides information about how CB handles your personal information and describes the rights you may have regarding your personal information. This Privacy Policy applies to CB and its online and offline collection, use and disclosure of your personal information.

    CB has an obligation to preserve the confidentiality and privacy of the Customer's data and information.

    CB shall not collect, process or disclose any personal data or information except in accordance with the specific controls provided in the Qatar Central Bank and the Organization of Financial Law No. [13], 2012 (the “Law”), Law No. [13], 2016 Regarding the Protection of the Privacy of Personal Data, the CBs’ Code of Conducts, instructions and circulars issued by Qatar Central Bank from time to time, instructions governing the confidentiality of information issued by Qatar Central Bank, including all amendments applicable to them from time to time.

    Overview

    1. Your privacy is very important to CB, and we understand how important it is to you. We want you to feel safe when using this App and are committed to maintaining your privacy when you use the App. We require our employees, suppliers and members to maintain confidentiality in accordance with applicable personal data protection laws in the state. This Privacy Policy (together with our Terms and Conditions) sets out the basis on which we process any personal data we collect from you, or that you provide to us. Please read the following carefully to understand our views and practices regarding your personal data.
    2. This Privacy Policy can be changed over time to comply with laws, regulations of our regulatory or to meet our changing business requirements.
    3. By "Personal Data" we mean any information relating to an identified or identifiable natural person.
    4. By using this App, you acknowledge your full agreement to CB's use of all your personal data for the purpose of the work of this App, and that you grant CB full and unconditional permission to use this information.
    5. This policy is an integral part of this Terms and Conditions, and all Terms and Conditions are applicable.
    6. CB reserves the right to change, adapt, adjust this Privacy Policy on the App without any prior notification. You acknowledge and agree that this Policy may change from time to time. By using this App, you agree to be bound by the latest version of such policy.

    Personal Data Collection and Purpose Specification:

    1. Your personal data, all electronic storage and transmission of personal data shall be safeguarded and secured with appropriate security technologies. By choosing to use the App, you agree to share your personal data with CB, and the relevant personal data will only be shared with third-party upon your prior consent or as permitted by laws. We will retain your personal data only as necessary for the effective delivery of our services.
    2. In the event that you are to disclose Personal Data on behalf of third party, you will ensure that the person whose Personal Data is supplied to CB has authorized the disclosure, is informed of and consents to processing of their Personal Data in accordance with this Privacy Policy. Upon receiving such data, CB shall assume that you have obtained the permission of the third party and the CB shall not bear any responsibility in the event that it is found that you did not obtain such permission.

    Third-party Apps links and Applications:

    This App may contain links to enable you to visit third-party Apps and mobile applications which are governed by their own privacy policies. You acknowledge that CB does not have any control over these Apps and applications and we are not responsible or liable for the protection and privacy of any information that you provide whilst visiting those Apps.

    Disclosure and User Choice:

    CB shall not disclose your personal data to any third-party without your prior consent, or as it is permitted by law e.g. the disclosure to: (a) the courts, (b) authorities of combating money laundering and terrorism financing, (c) our regulatory authorities, (d) if we believe disclosure is required by any applicable law, regulation or legal process (such as to respond to subpoenas or judicial orders), (e) or to protect and defend our rights, including to defend against legal claims.

    Privacy Support and Retention:

    1. We will retain your credit information for as long as it is necessary to fulfil the purpose for which it was collected as described in this Privacy Policy and in line with our data retention policies, or as required by relevant laws.
    2. When erasing your credit information, we will take reasonable and technically possible measures to make your credit information irrecoverable or irreproducible in accordance with the applicable laws and our policies.

    Credit Report:

    1. Credit report is the report that includes your credit information that CB obtained from its’ members or any other legitimate sources.
    2. You acknowledge that CB collects your credit information from its members and any legitimate bodies, and CB shall not be responsible for the inaccuracy, incorrectness, or incompleteness of any credit information contained in your credit report, as all credit information on which credit reports are based depend entirely on the credit information provided by third parties to CB, and in the event of any mistakes in your credit report, you must strive to correct them through the applied procedures in CB.
    3. You acknowledge that CB collects and exchanges your credit information with the members of CB upon your prior consent without any responsibility to CB for the accuracy or the correctness of your credit information. You agree that CB will not be liable to you for any direct, indirect or consequential loss you incur due to the inaccuracy incorrectness of your credit information.
    4. The official version of your credit report is provided in the Arabic language, which is available in hard-copy printed form. Only such Arabic versions are considered to CB as an official source of information. CB assumes no responsibility for the accuracy of other versions of documents posted herein, resulting from translating the Arabic originals into other languages.
    5. You acknowledge that once the Credit Report is downloaded through the App the ownership of the same get transferred to the end user (customer concern) and CB shall not be responsible for any kind of illegal copying, saving or usage of the Credit Report”.

    Credit Report Delivery Service:

    1. CB may provide you a service of credit report delivery by mail by a third party, and CB shall reserve the right to choose and to engage with the third party that provides this service.
    2. Based on your request and when you use the credit report delivery service through this App, you will be binding to pay CB in advance all fees and expenses resulting from providing this service to you, and you will be responsible for compensating CB for any financial loss incurs as a result of the implementation of your request.
    3. You acknowledge that you know that the service of delivering the credit report is made by a third party, and accordingly, in addition to these Terms and Conditions, you agree that this service is subject to the terms and conditions of the third party service, you have to review and verify the terms and conditions of the third party service, and by using this service, you acknowledge that you accept the terms and conditions of the third-party service.
    4. You acknowledge that CB shall not bear any legal liability and will not be liable to pay you any financial compensation for any direct, indirect, consequential, or other loss arising from the delay of the third party in delivering your credit report at the expected time to deliver it to you.
    5. CB shall have the right to stop this service at any time without prior notice.

    Fees and Payment:

    1. You are binding to pay CB the fees of the credit report(s) and the other services that you obtain through this App.
    2. CB shall reserve the right to amend the fees of the credit reports and any other services that provided by CB, at any time and without prior notification.
    3. At your request, you will be re-directed to a third-party App, wherein you can make your payment from a different bank account.
    4. CB shall not guarantee or warrant the accuracy or completeness of the information, materials, services or the reliability of any services, advices, opinions, statements or other information displayed or distributed on the third-party App.
    5. You shall access the App of the third-party solely for purpose of paying the fees of your credit report or any other services that provided by CB.
    6. You understand and acknowledge that availing of any services offered on such App or any reliance on any opinion, advice, statement, memorandum, or information available on that App shall be at your sole risk. CB and its employees, officers and directors expressly disclaim any liability for any deficiency in the services offered by the third-party whose App you are about to access.
    7. Neither CB nor any one of its employee, officers and directors will be liable to or have any responsibility of any kind for any loss that you incur in the event of any deficiency in the services of third-party to whom the App belongs, in the event of failure or disruption of the app of the third-party, or resulting from the act or omission of any other party involved in making that App or the data contained therein available to you, or from any cause relating to your access to, inability to access, or use of the App or these materials.

    Refund of Fees:

    1. Without prejudice to the provisions of the disclaimer and limitation of liability stipulated in these Terms and Conditions, in the event that you do not receive your credit report or any other services you have paid fees to CB, due to any technical malfunction in the system of CB, in this case CB shall provide you the required service in full without paying any other or additional fees, and in the event that CB is unable to provide you the required service, you will only be entitled to claim a refund of the fees that you have paid to CB for the service that you did not receive, in such case CB shall return the fees that you have paid to the bank account through which the payment was made within fourteen (14) working days from the date you filed the claim for a refund.
    2. Without prejudice to the provisions of the disclaimer and limitation of liability stipulated in these Terms and Conditions, in the event that your credit report fees or any other services are deducted more than once due to any technical malfunction in CB’s system, in this case you must submit a claim to CB within five (5) days from the date of the discount to recover the duplicate fees only, CB will return the fees that were double deducted to the bank account through which payment was made within twenty (20) working days from the date you have submitted the claim for redeeming the double fees.
    3. You acknowledge that the payment of fees for the credit reports and any other services of CB through bank cards and credit cards is carried out by a third party, and that the refunded fees from CB according to the cases mentioned in paragraphs (1,2) above shall be added to the accounts of such cards will be made by the third party. CB shall not bear any legal responsibility and will not be responsible for paying any financial compensation to you for any direct or indirect loss or dependency or any other loss arising from the delay of the third party in adding the refunded fees from CB to the account of the card that you have paid through.

    Force Majeure:

    1. CB shall not be held responsible for any failure to provide any of the services provided through this App if the prevention, impediment or delay of performance occurred due to force majeure and as shown below, and in such case the services shall be suspended as long as the force majeure continues.
    2. Force Majeure means any event that occurs for any reason that exceeds the ability and control of CB over it, including but not limited epidemics, piracy or breach of protection, encryption, fires, floods, explosions, judgment and destiny, earthquakes, wars, accidents, strikes, riots, blocking and blockade, and any restrictions imposed on CB that shall prevent it from providing the services mentioned on this App for reasons arising from acts of sovereignty by the State or a governmental body or authority affecting the work of CB.

    Complaints and Disputes Settlement:

    1. You have the right to file a complaint to CB within fifteen (15) days from the date you withdraw your credit report through this App, if you have a belief that your credit report includes inaccurate or incorrect credit information.
    2. By using this App, you acknowledge that you know how to file your complaint. Should you have any queries please contact us.
    3. You agree that your complaint shall be settled in accordance with the procedures of CB to settle disputes and complaints.

    Governing Law & Jurisdiction:

    This Terms and Conditions and the materials contained within the App shall be governed and construed in accordance with the laws of the State of Qatar. The Qatari courts shall have exclusive jurisdiction to adjudicate any disputes, which may arise as a result of using this App or obtaining the services of CB. You agree that CB reserves the right to bring an action against you in any country it deems appropriate.​
